John’s Comps Ltd – Terms and Conditions

1. Introduction

These Terms and Conditions govern all competitions operated by John’s Comps Ltd (“the Company”, “we”, “us”, “our”). By entering any competition hosted on our website, you agree to be legally bound by these Terms.

2. Eligibility

  • All entrants must be 18 years of age or older at the time of entry.
  • Competitions are open to residents of the United Kingdom unless otherwise stated, but entries from outside the UK may be accepted at our discretion.
  • Employees of John’s Comps Ltd, their families, agents, or anyone professionally connected with the competitions are not eligible to enter.
  • The Company reserves the right to require proof of age and identity.

3. Entry Requirements

  • You can enter our competitions in one of two ways:
  1. Paid entry: by buying entries through our website and paying the stated entry fee.
  2. Free postal entry: by sending an entry by post, as set out in section 4.
  • All entrants, paid or free, must correctly answer the competition question. Entries without the correct answer will not be entered into the draw.
  • It is the entrant’s responsibility to ensure all details provided are accurate and complete. We reserve the right to reject any entry which is incomplete, inaccurate, or otherwise does not comply with these Terms.

4. Free Postal Entry

You can enter any competition for free by sending an unenclosed postcard by first or second class post to:

[Creator Business Name], Free Entry, [Address], [Postcode]

Each postcard must include your full name, postal address, phone number, email address, the name of the competition you are entering, and your answer to the competition question.

  • Each postcard counts as one entry. Entries sent in envelopes, or postcards sent inside envelopes, will not be accepted.
  • You may enter by post up to the maximum number of entries per person shown on the competition page. Postal entries count towards that maximum, together with any paid entries.
  • Postal entries must arrive at least 3 clear working days before the competition closes. Entries received after this will not be included. Proof of postage is not proof of delivery.
  • Incomplete or unreadable postcards will not be accepted.
  • Once a postal entry has been received and processed, we will email the entrant their entry number.
  • Free postal entries are entered into the draw in exactly the same way as paid entries and have the same chance of winning.

5. Payment and Disputes

  • All payments must be made in full at the time of entry.
  • Any entrant who disputes or reverses a payment (chargeback) will have their entry deemed invalid and will be excluded from the competition until payment has been successfully resolved.
  • We reserve the right to recover any costs incurred due to payment disputes.

6. Competition Draws

The method of selecting the winner will be clearly stated on each competition page and will be one of the following:

  • Live draw: conducted by us in a fair and transparent manner, usually broadcast live; or
  • Automated random draw: carried out automatically when the competition closes, using the random draw system provided by our website platform, CompsLive.

All valid entries, whether paid or free, are included in the draw in the same way.

The winner’s name and ticket number will be published on our website after the draw.

All draw results are final and binding, subject to verification of the winner’s eligibility.

We reserve the right to delay a draw if necessary due to circumstances beyond our reasonable control. If this happens, we will let entrants know the new draw date as soon as practicable.

 

7. Odds of Winning

  • The odds of winning depend on the total number of valid entries received before the competition closes.

    The maximum number of entries available, and the number of entries sold so far, will be shown on the competition page so entrants can make an informed decision before entering.

    Each valid entry, whether paid or free, with a correctly answered question has an equal chance of being selected. We cannot guarantee specific odds, as the final number of entries will vary for each competition.

    Entering a competition does not guarantee winning.

8. Prizes

  • All prizes will be clearly described on the competition page.
  • No cash alternatives will be offered unless explicitly stated.
  • We reserve the right to substitute a prize with an alternative of equal or greater value if required.
  • Winners are responsible for any taxes, duties, or fees applicable outside the UK.
  • We accept no responsibility for any additional costs, taxes, duties, or expenses incurred in relation to the prize.

9. Winner Notification

  • Winners will be notified using the contact details provided at entry.
  • If a winner does not respond within a reasonable timeframe (typically 7–14 days), we reserve the right to redraw the prize.
  • Winners may be required to provide proof of identity and age.
  • Winners name and ticket number will be published on our website.
  • We shall not be liable for delays caused by third-party carriers, customs, or events beyond our reasonable control.

10. Delivery of Prizes

  • We will arrange delivery of prizes to the winner.
  • Delivery times may vary depending on the nature of the prize and location.
  • We are not responsible for delays caused by third-party couriers or customs for international deliveries.

11. Entry Limits and Minimum Entries

Each competition will show on its page:

  • The maximum number of entries available
  • The maximum number of entries per person, including both paid and free postal entries
  • Any minimum number of entries required for the prize to be awarded

If a competition has a minimum number of entries and does not reach it by the closing date, we may do one of the following, as stated on the competition page:

  • Extend the closing date to give more time to reach the minimum. We will let all entrants know the new closing date by email and on the competition page.
  • Award a cash alternative to the winner instead of the advertised prize. The amount, or how it will be calculated (for example, a percentage of total entry fees received), will be shown on the competition page before you enter.
  • Cancel the competition and refund all paid entries in full. Free postal entrants will be notified by email.

If a competition is extended and still does not reach its minimum, we will either award the cash alternative or cancel and refund, as stated on the competition page.

    12. Cancellation / Force Majeure

    • We reserve the right to cancel, suspend, or amend any competition at any time where it becomes necessary to do so due to circumstances beyond our reasonable control.
    • Such circumstances may include, but are not limited to:
      • Technical failures or platform outages
      • Fraud, abuse, or suspected manipulation of the competition
      • Legal or regulatory changes affecting the operation of the competition
      • Events of force majeure such as natural disasters, fire, flood, pandemic, war, industrial action, or similar unforeseen events
      • Failure of third-party services, suppliers, or payment processors
    • In the event of cancellation:
      • All affected entrants will be refunded in full for valid entries, unless otherwise stated
      • No further liability shall be accepted by the Company beyond the refund of entry fees
    • We will make reasonable efforts to notify entrants of any cancellation or material changes as soon as practicable.

     

    13. Liability

    To the fullest extent permitted by law, we will not be liable for any indirect or consequential loss arising from taking part in any competition.

    In particular, we are not liable for:

    • Technical issues beyond our reasonable control that prevent or delay an entry being submitted
    • Loss, damage or delay to prizes caused by third-party couriers or delivery services
    • Postal entries that are lost, delayed or damaged in the post

    Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Your statutory rights are not affected.

     

    14. Data Protection

    We will process your personal data in line with UK data protection law, including the UK GDPR and the Data Protection Act 2018.

    We use the information you provide to:

    • Process your entries and payments
    • Run the draw and contact the winner
    • Arrange delivery of prizes
    • Prevent fraud and comply with our legal obligations

    To do this, we may share your information with the service providers who help us run our competitions, such as our payment provider, our website platform (CompsLive) and delivery companies. We will never sell your personal data.

    If you win, your name and ticket number will be published on our website, as set out in section 6.

    We will only send you marketing about future competitions if you have agreed to receive it, and you can unsubscribe at any time.

    15. Fraud, Abuse and Unfair Participation

    We are committed to ensuring that all competitions are conducted fairly and transparently.

    • We reserve the right to disqualify any entrant where there are reasonable grounds to believe that:
      • Entries have been made using multiple accounts, identities, or devices to gain an unfair advantage
      • Automated methods, bots, scripts, or bulk entry services have been used
      • Payment methods have been used fraudulently or without proper authorisation
      • There has been any attempt to manipulate the outcome of the competition
      • The entrant has otherwise breached these Terms & Conditions
    • We may void entries, suspend accounts, or refuse participation where suspicious or abusive activity is identified.
    • Where fraud or abuse is suspected:
      • The Company reserves the right to withhold prizes pending investigation
      • Any affected entries may be declared void
      • No refunds will be issued where a breach of these Terms & Conditions has occurred
    • We reserve the right to request proof of identity, address, and payment method ownership before awarding any prize.
    • Any attempt to deliberately undermine the legitimate operation of a competition may result in:
      • Disqualification
      • Cancellation of entries
      • Legal action where appropriate
    • The use of chargebacks, payment disputes, or reversals after entering a competition may result in:
      • Immediate disqualification
      • Cancellation of all associated entries
      • Exclusion from future competitions
    • Our decision in relation to fraud, abuse, or unfair participation is final and binding.

    Any fraudulent activity may result in legal action.

    16. Amendments

    We may update these Terms and Conditions from time to time, for example to reflect changes in the law or in how we run our competitions.

    Any changes will be published on this page with the date they were last updated, and will apply to competitions launched after that date.

    Changes will not affect any competition you have already entered. The Terms that applied when you entered will continue to apply to that competition.

    17. Governing Law

    • These Terms and Conditions are governed by the laws of England and Wales.
    • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
